Terms of Service

These Terms of Service (“Terms”) govern your use of emeraldcityballhockey.com (the “Website”) and your registration for and participation in programs operated by Emerald City Ball Hockey Foundation (“Emerald City Ball Hockey,” “we,” “us,” or “our”), a nonprofit organization based in Mill Creek, Washington. By using the Website or registering for a program, you agree to these Terms. If you do not agree, please do not use the Website or register.

Eligibility and registration

Registration for a minor must be completed by a parent or legal guardian, who is responsible for the information submitted and for the player’s participation. You agree to provide accurate, current, and complete information and to keep it up to date. We may decline or cancel a registration at our discretion, including where information is inaccurate or where participation would be unsafe or disruptive.

Fees, payments, and refunds

League fees, camp and clinic costs, and other charges are shown at the time of registration and are payable through our payment processor (Stripe). You are responsible for all fees associated with your registration. Refund and cancellation terms for a specific program are provided at registration; unless otherwise stated, fees are non-refundable once a season or session has begun. If a program is canceled by us, we will offer a credit or refund as appropriate.

Participation, conduct, and safety

Players, parents, guardians, spectators, coaches, and volunteers are expected to act with good sportsmanship and respect and to follow program rules, facility rules, and the rules of our sanctioning body, USA Ball Hockey. We may remove any person from a program or event for conduct that is unsafe, abusive, or disruptive. Ball hockey is a physical activity that carries inherent risks; participation is also governed by the waiver and release you sign as part of registration, which is incorporated into these Terms.

Photos and media

We may photograph or record players and events for program operations and promotion (such as our website, newsletters, and social media). Any specific media-consent or opt-out terms are addressed in the registration and waiver materials. If you have concerns about the use of a player’s image, please contact us.

Acceptable use of the Website

When using the Website, you agree not to:

Use it for any unlawful purpose or in violation of these Terms;
Attempt to gain unauthorized access to the Website, its systems, or other users’ information;
Interfere with or disrupt the Website or introduce malicious code;
Copy, scrape, or misuse content without permission.

Intellectual property

The Website and its content — including logos, text, graphics, photos, and video — are owned by or licensed to Emerald City Ball Hockey and are protected by applicable laws. You may not use our name, logos, or content without our prior written permission, except as needed to use the Website for its intended purpose.

The Website may link to or rely on third-party services (such as payment processing and our sanctioning body). We are not responsible for the content, policies, or practices of third parties, and your use of their services may be subject to their own terms.

Disclaimers

The Website and our programs are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, Emerald City Ball Hockey and its directors, officers, volunteers, and coaches will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Website. Liability relating to participation in our programs is governed by the waiver and release signed at registration. Nothing in these Terms limits any liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Emerald City Ball Hockey and its directors, officers, volunteers, and coaches from claims, losses, and expenses arising out of your violation of these Terms or your misuse of the Website.

Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Website will be brought in the state or federal courts located in Washington.

Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the “Last updated” date above. Your continued use of the Website after changes take effect constitutes acceptance of the updated Terms.
